Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and RSE eLearning ("RSE eLearning," "we," "our," or "us") governing your access to and use of rseselearning.org and any related applications, content, courses, tools, and services we provide (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any policies referenced herein, including our privacy practices. If you do not agree, do not access or use the Services.

By using the Services, you represent that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

Eligibility

The Services are intended for users who are 16 years of age or older. The Services are not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn that a child under 13 has provided personal information through the Services, we will take appropriate steps to delete such information.

Accounts and Security

You may be required to create an account to access certain features. You must provide accurate and complete information and keep your account credentials confidential. You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or suspected breach of security. We reserve the right to suspend or terminate accounts that are inaccurate, incomplete, or used in violation of these Terms.

Description of Services

RSE eLearning is a trusted hub for evidence-based learning on medications, diseases, and dietary supplements. The Services may include concise drug monographs, disease overviews, supplement efficacy and safety information, treatment guidelines, clinical pearls, and tools to identify drug interactions and adverse effects. Content may be updated from time to time to reflect emerging research, science, and evidence.

Educational and Medical Disclaimers

No Medical or Professional Advice

The Services and all content are provided for educational and informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a physician, pharmacist, or other qualified health provider with any questions regarding a medical condition, diagnosis, or treatment, and never disregard professional advice or delay seeking it because of content on the Services.

Emergency Use

Do not use the Services for medical emergencies. If you believe you are experiencing a medical emergency, call your local emergency number immediately.

Dietary Supplements; FDA Disclaimer

Statements regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration. Dietary supplements are not intended to diagnose, treat, cure, or prevent any disease. Review product labels and consult a qualified health professional before use.

Professional Use and Clinical Decision-Making

Clinicians and healthcare professionals must use independent clinical judgment in evaluating the accuracy, applicability, and completeness of content. The Services may include summaries, guidelines, or research highlights that may not reflect the most current standards of care, local regulations, or individual patient circumstances. Use of the Services does not create a patient-provider relationship.

User Conduct and Acceptable Use

You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to the Services or related systems; (c) interfere with or disrupt the operation of the Services; (d) use automated means to access the Services without our permission; (e) upload or transmit viruses, malware, or harmful code; (f) reverse engineer, decompile, or disassemble the Services except to the extent such restriction is prohibited by applicable law; (g) infringe or violate the rights of others; or (h) misrepresent your identity or affiliation.

Intellectual Property Rights

Ownership

All content and materials on the Services, including text, graphics, data compilations, interfaces, logos, and compilations (collectively, "Content"), are owned by or licensed to RSE eLearning and are protected by U.S. and international intellectual property laws.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, educational, or internal professional purposes. Any use beyond this license, including copying, redistribution, or commercial exploitation of the Content, is prohibited unless expressly permitted in writing.

Trademarks

RSE eLearning and associated names, logos, and marks are trademarks or service marks of RSE eLearning. All other marks are the property of their respective owners. Nothing in the Services grants any right to use any trademark without prior written permission.

User Content and Feedback

If you submit, upload, or provide comments, feedback, suggestions, questions, reviews, or other content ("User Content"), you grant RSE eLearning a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, display, and otherwise exploit such User Content in any media for any lawful purpose. You represent and warrant that you own or have the necessary rights to submit User Content and that it does not infringe any third-party rights or violate any law.

We may, but have no obligation to, monitor, remove, or edit User Content at our sole discretion.

Third-Party Content, Tools, and Links

The Services may include links to third-party sites, tools, datasets, publications, or services. We do not control, endorse, or assume responsibility for third-party content or practices. Your use of third-party resources is at your own risk and may be subject to additional terms and privacy policies.

Payment, Subscriptions, and Refunds

Certain features or content may require payment or a subscription. Prices, fees, and billing terms will be disclosed at the point of purchase and are subject to change with notice. Unless otherwise stated, subscriptions renew automatically until canceled. You may cancel before the next billing cycle to avoid further charges. Refunds, if any, are issued in our sole discretion as permitted by law and any posted refund policy applicable at the time of purchase.

Trials, Promotions, and Coupons

We may offer free trials, promotions, or coupons subject to specific terms. We reserve the right to modify or terminate such offers at any time. If you do not cancel a trial before it ends, your subscription may convert to a paid plan at the then-current rate.

Privacy

Your use of the Services is subject to our privacy practices, which describe how we collect, use, and disclose information. By using the Services, you consent to our collection and use of information as described therein.

Data, Security, and HIPAA

We implement reasonable administrative, technical, and physical safeguards designed to protect information processed by the Services. However, no method of transmission or storage is completely secure, and we do not guarantee absolute security. Unless expressly stated in a separate written agreement, RSE eLearning is not a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act (HIPAA) and does not accept protected health information (PHI). Do not submit PHI through the Services.

Compliance with Laws

You are responsible for complying with all applicable laws, rules, and regulations in connection with your use of the Services, including those related to healthcare, clinical practice, privacy, data protection, advertising, and professional licensure.

Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RSE ELEARNING OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES; OR DAMAGES RESULTING FROM (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Certain jurisdictions do not allow limitations on implied warranties or exclusion of certain damages; in such jurisdictions, some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless RSE eLearning and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your infringement or misappropriation of any intellectual property or other rights of any person or entity.

Export Controls and Sanctions

You may not use, export, or re-export the Services except as authorized by U.S. law and the laws of the jurisdiction(s) in which the Services were obtained. You represent that you are not located in, under the control of, or a national or resident of any country or on any list subject to U.S. trade embargoes or sanctions.

Accessibility

We strive to make the Services accessible and usable for all users. If you encounter accessibility barriers, please contact us so we can assist and improve our offerings.

Changes to the Services and Terms

We may modify, update, or discontinue the Services, in whole or in part, at any time without liability. We may update these Terms from time to time. Changes will be effective when posted to the Services or when we otherwise provide notice. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

Suspension and Termination

We may suspend or terminate your access to the Services, with or without notice, for any reason, including if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Services will cease immediately, but provisions that by their nature should survive will remain in effect, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

Electronic Communications, Notices, and Consent

By using the Services, you consent to receive communications from us electronically, including emails and in-Service notices. You agree that all terms, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

DMCA Copyright Policy

We respect intellectual property rights. If you believe that material on the Services infringes your copyright, you may send a notice pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512) including: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material; (d) your contact information; (e) a statement that you have a good faith belief that use of the material is not authorized; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act. Send notices to our designated agent at: [email protected]. Counter-notifications must comply with 17 U.S.C. § 512(g).

Arbitration Agreement and Class Action Waiver

To the fullest extent permitted by law, you and RSE eLearning agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services ("Disputes") through binding individual arbitration rather than in court, except that either party may seek equitable relief in court for alleged infringement or misappropriation of intellectual property rights. This arbitration agreement is governed by the Federal Arbitration Act (FAA).

Arbitration will be administered by a reputable arbitration provider under its applicable consumer/commercial rules. The arbitrator shall have exclusive authority to resolve Disputes, including issues relating to the interpretation, enforceability, or scope of this arbitration agreement. UNLESS PROHIBITED BY LAW, YOU AND RSE ELEARNING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

Opt-Out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending an email with your full name, account email, and a clear statement that you wish to opt out to [email protected]. If you opt out, you will retain your right to litigate Disputes in court, subject to the Governing Law and Venue section.

Governing Law and Venue

These Terms and any Dispute are governed by the laws of the United States and, where not preempted, the internal laws of the state with which RSE eLearning is principally associated, without regard to conflict-of-laws principles. Subject to the arbitration agreement above, exclusive jurisdiction and venue for any permitted court proceedings shall be in the state or federal courts located in a competent venue associated with RSE eLearning, and you consent to the personal jurisdiction of such courts.

Miscellaneous

These Terms constitute the entire agreement between you and RSE eLearning regarding the Services and supersede all prior or contemporaneous agreements on the subject matter. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction. There are no third-party beneficiaries to these Terms.
